Kelly D. Herrera
Kelly Herrera is a litigator who represents and defends clients in matters involving business and commercial disputes, contract disputes and products liability. In addition to her litigation practice, Ms. Herrera has experience in corporate law, including expertise in employment and business contract preparation, review, and negotiation.
REPRESENTATIVE EXPERIENCE
- Obtained defense verdict in jury trial in Harris County on behalf of a Houston-based corporation in a complex business dispute involving allegations of negligence, misrepresentation, and breach of contract
- Second chair in products liability jury trial representing twolargeappliance companies; primary responsibility for briefing that resulted in directed verdict on behalf of both defendants on all three causes of action
- Second chair in personal injury jury trial in the United States District Court for the Eastern District of Texas, Lufkin Division, which resulted in unanimous defense verdict
- Lead briefing attorney in two appeals to the First Court of Appeals of Texas involving complex business tort issues; both appeals resulted in affirmation of lower court ruling in favor of our clients on a Plea to the Jurisdiction.
- Successfully obtained full summary judgment for a national retailer in a suit involving pregnancy and sex discrimination
- Obtained full summary judgment for three local businesses in a commercial dispute involving issues of liability for independent contractors, breach of contract, and discrimination
